Expert Witness Testimony

A local law firm recently represented a municipal client on a local siting issue.  They needed an expert to assist with their case, and Total Environmental Solutions was their choice.  We participated in consulting sessions with the client, conducted an extensive document review and prepared to testify in the case.  Mr. Seith's depth of experience in the regulatory field and his familiarity with local siting issues became key elements in formulating an approach that made sense for the firm and the municipality involved.

Environmental Assessments

TES is well versed in state and federal environmental regulations that affect the purchase and sale of real property.  It is especially important to know what (if any) your liability will be before you commit to closing a real estate transaction. TES can help you assess the situation and guide you to a satisfactory outcome.

A company recently wanted to purchase a parcel of commercial property.  Concerned about possible contamination of the site, and needing to know their potential liability, they called TES.  We met with the client to discuss the scope of the project and their plan for the property.  It was decided that a Phase 1 environmental study would be appropriate.  We put together a team of experts and then oversaw the process to its conclusion.  The resulting report aided the client in a successful negotiation for the acquisition of the property.

Environmental Audits and Compliance Calendars

While we are all tempted to “leave well enough alone” when things seem to be going fine, it is usually wise – and ultimately more cost effective – to be proactive about environmental issues rather than reactive.  Once the regulators are knocking at your door with violation notices in hand, it becomes a costly process to set things right.  TES can help you avoid such distressing encounters.

A major graphics company recently saw the merit of a preventative approach and asked us to help.  We briefly toured the plant and then went to work.  We assembled a team of experts and advisors who, together with TES conducted a thorough audit of the facility.  An audit report highlighted areas where improvements could be made to enhance environmental compliance and avoid possible violations.

The client was so pleased with the outcome that they then hired TES to coordinate and conduct a hazardous waste audit at the same facility.  As with most cases, investing in these improvements now will avoid the much higher cost of compliance, including penalty assessments, later.
